Terms and Conditions

These Terms and Conditions ("Terms") govern your use of luxonas.com and any purchases made through it. By placing an order, you confirm that you have read, understood, and accepted these Terms.
1. About us
Luxonas Home is a company registered in Malta with VAT number MT20426103. Our registered office is at Triq L-Mdina, Żebbuġ ZBG 09018, Malta. Our showroom is at Triq L-Mdina, Żebbuġ ZBG 09018, Malta.
In these Terms, "we," "us," and "our" refer to [Registered company name] trading as Luxonas Home. "You" refers to the customer placing an order through our website.
2. Eligibility
To place an order, you must be at least 18 years old and capable of entering into a legally binding contract.
3. Products
We sell furniture, lighting, home accessories, décor, and menswear. Product images on our website are for illustrative purposes. While we make every effort to ensure colours, textures, and finishes are represented accurately, slight variations may occur due to natural materials, manufacturing processes, and screen calibration.
Dimensions, materials, and finishes are listed on each product page. Where natural materials are used (timber, stone, leather, linen, travertine), some variation in grain, tone, or texture is to be expected and is part of the character of the piece.
4. Pricing
All prices are shown in Euros (EUR / €) and include Maltese VAT where applicable. Delivery costs, where they apply, are shown at checkout.
We reserve the right to change prices at any time before an order is confirmed. Once an order is confirmed and payment received, the price will not change.
In the event of a pricing error on the website, we are not obliged to fulfil the order at the incorrect price. We will contact you with the correct price and offer the option to proceed at the corrected price or cancel the order with a full refund.
5. Orders and contract formation
When you place an order through our website, you are making an offer to purchase. We will send you an order confirmation by email acknowledging receipt of your order. A binding contract is formed only when we send a separate dispatch confirmation or, in the case of made-to-order items, written confirmation that production has begun.
We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) cases of suspected fraud, stock unavailability, pricing errors, or where delivery is not feasible.
6. Payment
Payment is taken at the point of order. We accept [list payment methods — cards via Stripe / Shopify Payments, bank transfer, etc.]. All payments are processed through secure third-party payment providers; we do not store full payment card details on our servers.
For made-to-order and bespoke pieces, we may require [a deposit of X% / full payment] at the point of order. The terms applicable to your specific order will be confirmed in writing before production begins.

Delivery terms, timeframes, and conditions are set out in our Shipping Policy, which forms part of these Terms.
8. Right of withdrawal (consumer cancellation right)
Under EU consumer law and Maltese implementing legislation (Consumer Rights Regulations, Subsidiary Legislation 378.17), if you are a consumer, you have the right to cancel an online purchase within 14 calendar days of receiving the goods, without giving a reason.
To exercise this right, you must notify us in writing (email is acceptable) at info@luxonas.com within the 14-day period.
You must return the goods to us, at your own cost unless otherwise agreed, in their original condition and packaging, within 14 days of notifying us of the cancellation. We will refund the purchase price (and original standard delivery cost) within 14 days of receiving the returned goods, using the same payment method you used for the original transaction.
Exceptions to the right of withdrawal:
The 14-day cancellation right does not apply to:
- Goods made to your specifications or clearly personalised (this includes made-to-order furniture, custom upholstery, bespoke pieces, and items ordered in non-standard finishes, fabrics, or dimensions).
- Goods that have been used, damaged, or are not in re-sellable condition on return.
- Sealed goods that have been unsealed where return would not be hygienic (e.g., bedding once opened).
This is consistent with Article 16 of the EU Consumer Rights Directive and its Maltese implementation.
9. Made-to-order and bespoke items
Made-to-order furniture and bespoke pieces are produced specifically for you and cannot be cancelled, returned, or refunded once production has begun, except in the case of defects, damage, or material non-conformity with the agreed specifications.
You will receive written confirmation of specifications and lead times before production starts. Please review these carefully — once you confirm, the order proceeds to production.
10. Returns and refunds
Our full Returns Policy is set out separately and forms part of these Terms. In summary:
- Standard in-stock items may be returned within 14 days of delivery, in original condition, for refund or exchange.
- Made-to-order, bespoke, and custom items are not returnable except in the case of defect or non-conformity.
- Damaged or defective items must be reported within [X working days] of delivery.
11. Warranty and guarantees
All goods are sold with the legal guarantee of conformity required by Maltese and EU consumer law. Where a product is defective or does not conform to its description, you are entitled to repair, replacement, price reduction, or refund, in accordance with applicable law.
Some products carry an additional manufacturer's warranty. Where applicable, the warranty period and terms will be stated on the product page or accompanying documentation.
Natural variation in materials such as timber grain, stone veining, leather marking, or fabric weave is not considered a defect.
12. Limitation of liability
To the extent permitted by Maltese law, our liability for any loss or damage arising in connection with goods purchased through our website is limited to the price paid for the goods.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.
Nothing in these Terms affects your statutory rights as a consumer under Maltese or EU law.
13. Intellectual property
All content on luxonas.com — including text, images, logos, product photography, and design elements — is owned by [Registered company name] or licensed to us, and is protected by copyright and trademark law. You may not reproduce, distribute, or use this content without our prior written consent, except for personal, non-commercial browsing.
14. Use of the website
You agree to use our website only for lawful purposes. You may not:
- Attempt to gain unauthorised access to our systems or data.
- Use the website to transmit any unlawful, harmful, or fraudulent content.
- Use any automated means (bots, scrapers) to access or collect content from the site without our written permission.
15. Privacy and data protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and Maltese data protection law. Our Privacy Policy explains what data we collect, why, and your rights — please refer to it separately.
16. Changes to these Terms
We may update these Terms from time to time. The version in force at the time of your order is the version that applies to that order. The current version is always available on luxonas.com.
17. Governing law and jurisdiction
These Terms are governed by the laws of Malta. Any disputes arising in connection with these Terms or any order placed through luxonas.com shall be subject to the exclusive jurisdiction of the Maltese courts, save where mandatory consumer protection law provides otherwise.
